DL-Aspartic acid, a racemic mixture of D- and L-aspartic acid, is used in food additives for flavor enhancement and as a precursor in synthetic sweeteners. Regulatory bodies such as the Joint FAO/WHO Expert Committee on Food Additives (JECFA) and the U.S. Food and Drug Administration (FDA) have established guidelines to ensure its safe consumption. 

 

ADI Determination by JECFA

 

JECFA evaluates the safety of food additives through toxicological studies, including acute, subchronic, and chronic toxicity tests. For DL-aspartic acid, metabolic studies indicate that the L-form is naturally metabolized, while the D-form is excreted or slowly converted. Based on available data, JECFA has not established a specific ADI for DL-aspartic acid, classifying it under "No safety concern at current levels of intake" when used following Good Manufacturing Practices (GMP).

In contrast, JECFA has set an ADI of 0-40 mg/kg body weight for aspartame, a derivative of L-aspartic acid. The lack of a defined ADI for DL-aspartic acid suggests that its consumption in typical food applications does not pose significant health risks. However, manufacturers must adhere to purity standards, ensuring minimal contaminants such as heavy metals and residual solvents.

 

FDA Regulatory Status and Labeling Requirements

 

The FDA regulates DL-aspartic acid under the Generally Recognized as Safe (GRAS) designation when used as a flavor enhancer or pH regulator. Unlike JECFA, the FDA does not specify an ADI but requires that its use complies with GMP to avoid excessive intake.

Labeling requirements mandate that DL-aspartic acid be listed by its common or usual name in the ingredient list. If used in aspartame production, the final product must declare aspartame rather than the individual components. Additionally, products containing DL-aspartic acid must comply with allergen labeling if derived from potential allergen sources (e.g., microbial fermentation using wheat-based substrates).

 

Comparison of JECFA and FDA Approaches

 

While JECFA provides a global benchmark for safety assessments, the FDA's GRAS system allows more flexibility for substances with a long history of safe use. Both agencies emphasize the importance of purity and manufacturing controls but differ in their ADI specifications. JECFA's absence of a numerical ADI reflects confidence in its safety at typical usage levels, whereas the FDA relies on industry compliance with GMP.
